Andrezej Latoszewski is accused of murdering Sebastian with his long-term partner, and Sebastian's mother, Agnieszka Kalinowska, on August 13 last year. Sebastian was found with serious injuries at his home, 301 Leeds Road, Huddersfield, and died later the same day in hospital. The defendants are charged with murder, manslaughter, neglect, and allowing or causing the death of a child. Latoszewski has admitted manslaughter and both defendants have admitted cruelty to a child under the age of 16. Prosecutors at Leeds Crown Court say Sebastian suffered "torture," assaults and beatings in the run-up to his death. The court has heard from family friends about "punishments" he had to endure, and about texts between the defendants describing what they were doing as "torture." The footage was captured on Latoszewski's mobile phone, unlike later videos which were captured on a CCTV system allegedly set up by the defendants inside the family home. On the footage - which was described as "harrowing" by the Honourable Mrs Justice Lambert - Sebastian can be seen sitting in a large, beige chair with a TV on behind him. He can be seen holding a notepad and pen and is wearing a light blue T-shirt as he speaks to Latoszewski. Before the footage - which was 25 minutes in total - was played, Jason Pitter QC, prosecution, read out a transcript of what was said in the footage, whereby Sebastian and his step-father spoke in Polish. The translation outlined a conversation they had about whether Sebastian had used Latoszewski's torch and had entered a basement with two rooms at their home. Sebastian Kalinowski Throughout the conversation, Latoszewski could be heard calling Sebastian a "w***" and hitting him, with what the prosecution say is a spindle. Throughout the footage, Sebastian could be heard crying out in pain and pleading for it to stop. He can also be heard addressing Latozsewski as "Mr Andrezej." Sebastian said: "I will tell Mr Andrezej everything" before he was struck and made noises of pain. Latoszewski then said: "I am waiting w****, taking this hand w****, what were you doing w****?" The teenager can then be heard saying "No I will tell Mr Andrezej what is was," to which Latoszewski replied: "What is this w****? F****** smashed elbow is it? I will f****** hit you more w****." Latoszewski and Kalinowska Sebastian can then be heard telling Latoszewski "I don't want to be hit anymore" before his stepfather mocks him and says "hee, hee, hee" and Sebastian says: "Mr Andrezej please." Mr Pitter told the court that later in the footage there is then "sounds of pain" and Sebastian saying "no more." He can then be heard pleading and screaming at that point before Latoszewski continues to call him a "w****." At a later stage in the footage captured, Mr Pitter said Latoszewski tells Sebastian: "You shouldn't have lied about it, now you're f***, screwed. I will not let you in my house. I am listening to you w****, come clean, come clean, I have time w****, I have all day tomorrow, all evening. Because you w****, you will not eat, sleep or rest w****. You attack me, so I will be attacking you. You are attacking me in my house. I'm waiting for the truth.

"See, I've sorted it out without mummy. Tell me what you have seen w****. It is very important for me, you will admit it or I will be torturing you for so long you will admit it." Earlier on during Monday's proceedings, the landlord of 301 Leeds Road told in a statement read to the court how he discovered a CCTV system had been put up in the property. He said: "Sometime after he moved into the house I attended to cut back some bushes and I noticed a camera under a windowsill, and a camera in the garden, situated between plants." The landlord said no one has asked him permission to install it and when asked about it they said they felt "unsafe" and tenants next door were "rough." He said he became aware of a camera in the living room and he knew from Andrew "he could view the footage on his phone."

He said: "I know there was at least one internal camera." The court heard that the landlord had intended to sell the property - but did not tell the defendants at the time, but arranged for estate agents to carry out valuations at the property. He said: "They were not very happy at all, they had their own personal things in the house, especially when an estate agent had been a week before. I was quite surprised - I had never had any problems with them." The landlord said he had seen Sebastian and described him as a "lovely boy" from what he could tell. He said: "He appeared quite smart. I never saw any aggressive physical aggression from him or towards him. He was calm or appeared to have to think when you spoke to him. He was a lovely boy, not naughty. He clearly respected his parents. He was quite normal so didn't expect anything to happen." He added that in the time he knew the defendents - who he knew as Agnes and Andrew, he had not seen much change in her, but Latoszewski "always seemed to be exercising and kickboxing and had been nowhere near as built as he was." He said: "He spoke of himself like he was superman. Whenever I saw him exercising in the garden, I always felt he looked energetic." The trial continues.
